These Terms of Service (“Terms”) govern your access to and use of the PlateBird mobile application and related services (the “App”), operated by PlateBird (“we,” “our,” or “us”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using PlateBird, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

If you are using the App on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

PlateBird is a calorie and macronutrient tracking application that allows users to log meals via text entry and AI-assisted photo recognition. The App provides nutritional estimates and tracking tools for informational purposes only.

PlateBird does not provide medical advice, diagnosis, or treatment. The nutritional information generated by the App is based on estimates and may not be fully accurate.

3. No Medical Advice

The App is intended for general informational and educational purposes only.

You acknowledge and agree that:

  • Nutritional estimates are approximations.
  • The App is not a substitute for professional medical advice.
  • You should consult a qualified healthcare provider before making dietary or health-related decisions.
  • You use the App at your own risk.

If you have a medical condition, dietary restriction, or health concern, you should consult a licensed professional before relying on the App.

4. User Accounts

Some features may require you to create an account.

You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your login credentials.
  • Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes.
  • Reverse engineer, copy, modify, or distribute the App.
  • Attempt to interfere with the App’s operation or security.
  • Upload harmful, abusive, or malicious content.
  • Use automated systems to access the App in a manner that burdens our infrastructure.

We may suspend or terminate access if you violate these Terms.

6. AI-Generated Results

The App uses artificial intelligence to estimate nutritional information from user input and photos.

You understand that:

  • AI results may be incomplete or inaccurate.
  • Outputs should be independently verified when precision matters.
  • We are not responsible for errors in AI-generated results.

Use of AI-based features is at your own discretion.

7. Subscriptions and Payments

Some features of PlateBird may require a paid subscription.

  • Subscription pricing is displayed in the App.
  • Payments are processed through Apple’s App Store.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You manage and cancel subscriptions through your Apple ID account settings.
  • All billing and refunds are handled by Apple in accordance with their policies.

We do not directly process payment information.

8. Intellectual Property

All content, trademarks, branding, software, and design elements of the App are owned by or licensed to PlateBird.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, distribute, modify, or create derivative works from the App without our written permission.

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and handle information.

By using the App, you acknowledge that you have read and understand the Privacy Policy.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if:

  • You violate these Terms.
  • We discontinue the App.
  • We believe your use poses legal or security risk.

Upon termination, your right to use the App immediately ends.

11. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Accuracy or reliability of results

We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law:

PlateBird shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, health outcomes, or financial losses arising from your use of the App.

Our total liability for any claim relating to the App shall not exceed the amount you paid for the App in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless PlateBird and its affiliates from any claims, damages, liabilities, and expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of a third party

14. Changes to the Service

We may modify, suspend, or discontinue any part of the App at any time without liability.

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict of law principles.

If you are a consumer in the European Union, you may have mandatory legal rights under the laws of your country of residence.
